He did:

BIRMINGHAM | University of Tennessee coach Phillip Fulmer was issued a subpoena to testify in former Alabama booster Wendell Smith’s lawsuit against the National Collegiate Athletic Association and others Thursday morning.

Fulmer was ordered to appear Sept. 25, at the law firm of Blankenship, Harrelson & Wollitz, LLC in Birmingham.

Fulmer was handed the subpoena, which was made official Wednesday by the circuit court of Jackson County, as he walked down radio row at SEC Media Days at the Wynfrey Hotel.

Fulmer has never testified under oath about his involvement with the NCAA’s investigation of Alabama football, which led to probation and loss of scholarships. Under the advice of his attorneys, he skipped the 2004 Media Days, and was fined $10,000 by the SEC, after attorneys for former Alabama coaches Ronnie Cottrell and Ivy Williams vowed to issue a similar subpoena.

He didn't:

COACH FULMER: I have not seen that. I have not seen a subpoena. As I said to all the other groups, this is not the place for that kind of thing. There are great fans that have great passion about the Southeastern Conference that are not interested in that kind of BS. And I would have some other choice words if there weren’t so many cameras in here (smiling).
